The 2026 Annual Meeting was held at Miss Kitty’s Steak House on August 22n’d . The results of the outgoing board ’s effort to come into compliance with the POA’s primary role per the CC&Rs is “Road” maintenance . A plan including a budget was developed by Brian Marsh that was approved by the board including a maintenance plan for all roads in our two project areas. These roads where created by the developer and approved by the county and are maintained as primitive roads using drainage, grading and cinders as needed. In areas that are a recurring maintenance problem additions of capital improvements will be considered if determined to be necessary.
There are no capital improvements planned for 2027 .
In 2027 assessments will be assessed on a per acre basis based on the budget which will be adjusted in future years as determined from actual expenses from the prior year. When actuals exceed the budget the per acre assessment will be increased. if actuals are lower than budgeted the assessment may decrease.

In the Q&A after Brian’s presentation it was expressed the board was not enforcing items in the CC&Rs for people occupying trailers that aren’t permitted in accordance with county state and AQED requirements. The CC&Rs do restate the obligation of owners to comply with county, open range laws, state and AQED however observed violations should be reported to the appropriate governmental agency . It is not the responsibility of the board to act as code enforcement and police property owners for compliance with the law. We do not patrol our neighbors looking for violations some might expect of an HOA! Our concern is to look at residential issues that impact our roads, items in the CC&Rs where we would have a direct impact is no residence shall operate a business that causes non-owner customers to transit our roads . During the last amendment to the CC&Rs air bnbs and Verbo type short term rentals are prohibited and would be enforced by the POA. Exceptions to short term rentals is if the owner owned the property prior to the amendment may be grandfathered.
Property owners who tend to use the property recreationally and on occasion are not in our purview as we have no mechanism to track owner activities nor do we want to unless it impacts our roads or health & safety. Any property owner that has concerns with a neighbor we recommend working with your neighbor if possible. If it is a county/state regulation then seek their assistance. Over the years the board has been approached by owners who have an issue with their immediate neighbor but nothing was actionable by any agency because no rules or regulations were being violated. Another case was barking dogs that had become a nuisance to a neighbor. This was not actionable by the POA and the owner was directed to open a complaint with county animal control.
If a neighbor finds an untenable situation owners can bring it to the board‘s attention and we will attempt to direct you to the proper agency.

Our roads are privately owned and maintained. They cannot be used to access property outside of Howard Mesa Ranch or 4Hills. Any use is considered trespassing. Specifically Clear Air Estates II is not permitted to use our roads.
Drive Slowly: One of the major contributing factors to the washboard effect of the roads is speed. The roads are clearly posted with 30 mph speed signs. Driving at the speed limit or below will help reduce the washboard effect.
